Terms and Conditions

1. Definitions

Account: means a section reserved for each Registered User allowing him to manage, participate, purchase and track his activity on PyraBid

Administration Fee: means a fee that is charged to any Registered User for administration of his Account as in case of Refund Request

Auction: refers to the Auction of a Product which is time critical and subject to a specific number of bids, on which all Registered Users may Bid

Bid: refers to the action of spending one or more Credits on an Auction by the user to try and win the auctioned product

Bid Cost: Participation Fee required in order to Bid on an Auction

The Company means P & M Horizons Ltd, 71--75 Shelton Street, Covent Garden, London, WC2H 9JQ

Credits: refer to the virtual PyraBid funds which a Registered User may purchase, or otherwise acquire, in order to Bid on Auctions on the website

Lowest Unique Bid: refers to the lowest amount bid placed by the User when the auction closes

Non Unique Bid: refers to a Bid placed on an ongoing Auction which amount is identical to any other User’s bid in the same auction

PyraBid: means the website run by the Company

Payment Options: means the options available to a Registered User to pay for Auctions, Credits or any Services supplied by the Company.

Product: means any item auctioned on the website, excluding Credits

PyraBoard: refers to the leader board for each auction with the standing position of the User according to their bid amount

Registered User: refers to any person who registers an Account on the website

The Return Time Period means within 14 days of the delivery of a Product to a Registered User

Time Period for Payment of Winning Bid means any time within 14 days of a Winning Bid

Timer: refers to the remaining time on the auction

User: refers to any person who had registered an account on PyraBid and who places a Bid on any item on the website

Unique Bid: refers to a Bid placed on an ongoing Auction which amount is not identical to any other User’s bid in the same auction

Winning Limit: means the number of Products a User may win within a certain time period.

Website: includes the head site domain Pyrabid.co.uk, and all other generic sub-domains.

My PyraBid means the Registered User’s account section on the website where he may edit his account details and view his recent activity including wins, Credits spent, bidding history and bonus received

Winning Bid means the price of any Auction on which the Countdown Timer has reached zero and the number of remaining bids has reached zero

Winning Bidder means the Registered User who placed the Winning Bid on an Auction

2.Concept

The Company's Web Site offers a unique online platform to all our users to enjoy, participate and grab an opportunity to win items at a marginal cost compared to its RRP.

3.Acceptance

Please read and print these Terms and Conditions carefully before using this site. These Terms and Conditions apply to the use of PyraBid’s website. Registered Users and Visitors to the website agree to be bound by these Terms and Conditions in their entirety, which constitute a legal binding contract between the Company and its Users.

4. Business Relationship

These Terms and Conditions are effective immediately and apply to the business relationship between:

4.1 P&M Horizons Ltd, including its website PyraBid, and

4.2 its Registered Users and Visitors.

 

5. Right to Amend Terms and Conditions

The Company may at any time and at our sole discretion change our Terms and Conditions. Once amended, all Users and Visitors will have to accept our new Terms and Conditions in order to continue using the website.

6. Registration

In order to register an Account on PyraBid, you must comply with all of the following:

6.1 be over the age of 18. The Company may reserve the right to ask for proof of age at any time for verification.

6.2 be able to enter into legally-binding contracts with the Company.

6.3 be an individual only and not act as part of a commercial/reseller organisation

6.4 give genuine personal information

6.5 hold a valid Debit/Credit card

If a Registered User does not fulfil these requirements at the time of registration then the contract will be void. Furthermore, a User warrants by registering with the website, that he has read, understood and agreed to the Company’s Terms and Conditions and Privacy Policy.

6.6  A Registered User is forbidden to open/register multiple accounts on the Company’s Website. The Company reserves the right to close the duplicate account and ban the user.

6.7 A Registered User’s account, balance credits, and wins are not transferable, i.e. they cannot be transferred to any other user or account.

6.8 A Registered User is required to choose a Username at the time of registering on the website complying with all of the following: it must not be offensive or infringe the right of a third party, and it must not reflect personal opinions, or advertise the services of any other Company or third party.

6.9 At the time of registration, all Registered Users must carefully choose a password. Please be advised that the Registered Users are solely responsible for any activity undertaken using their account, and that they should not disclose their personal information (i.e. Username and Password) to anyone.

6.10 Any person who is in a business relationship with the Company will not be benefitted from any right that this Contract sets up.

6.11 The Company reserves the right to verify the identity of any Registered User at any time, and in the meantime, his activities on the website will be temporarily suspended until the process has been successfully completed.  In order to verify the identity of a Registered User, the Company may ask for a photo ID documentation, proof of address or any other documentation deemed necessary.

6.12 Individuals living in the same house are not allowed to bid on the same Auction, as this could be perceived by the Company as an act of collaboration between Users.

7. Termination of Contract

7.1 A Registered User has the right to terminate this Agreement at any time. In the event a User wishes to cancel the use of the Company’s service, he will have to contact the Company’s Support Team at: support@pyrabid.co.uk

7.2 The Company has the right to terminate this Agreement at any time and at our sole discretion.

8. How Auctions Work On PyraBid

Purchasing Credits:

8.1 In order to participate in any Auction, a Registered User is required to purchase a credit package choosing from one of our 4 packages: Basic, Economy, Premium and Deluxe. Once the credit package has been purchased by the User, his account will be automatically credited with the bids for that specific package.

8.2 Each Auction will display the Bid Cost per bid. Once the User has placed a Bid, the number and value of Credits/Free Bids will be deducted from his Account.

8.3 Credits can be purchased from our 4 Credits Packages listed on the Web Site. Typical prices range from the Basic Package worth £20 credits + £20 worth free credits to the Deluxe Package worth £150 credits + £150 credits worth bonus + *£15 Amazon Gift Voucher + 40 free credits for the first deposit. Please refer to our credit packages for further information.

* Users will have to contact the Support Team to claim his Amazon voucher within the first 3 months only, after which the voucher will be forfeited.

8.4  A contract for the supply of the Credit Package comes into being when the Registered User:

  • chooses one of our four Credit Packages,
  • agrees to pay for the Credit Package he has selected through one of the Payment Options,
  • confirms his acceptance to our membership subscription with rewards and
  • confirms his acceptance to our Terms and Conditions and our Privacy Policy to proceed.

Bought Credit Packages contain virtual funds which can be used to participate in any auction listed on Company’s website according to the Bid Cost mentioned on that Auction.

Please be advised that Credits purchased or spent cannot be returned to the Registered User, including Free Bids, i.e. all the Credits are non-refundable and cannot be converted into cash.

8.5  Free Credits will be awarded to the User’s account subject to their Membership subscription and the Credit Package chosen. The monetary value of a Free Bid is £0.00. Free bids can be used to participate in any auction irrespective of their Bid Cost (for example, whether the Bid Cost is £1.00 or £3.00, for each Bid placed, only one Free Bid will be deducted from the User's account).

8.6 Credits are deducted in the order in which they were acquired. In the event a Registered User placed a number of Bids including Free Bids and claims a Refund, his request will be denied.

8.7 All Credits have a specified time limit before they come to expire and are removed from the Registered User’s Account. All Credits including Free Credits are bound to expire one year after being credited to an Account.

8.8 PyraBid's Terms and Conditions forbid Registered Users to place more than 5 consecutive Unique bids in an Auction to secure his place / bids. In the event that the auction on which such a User has bidded more than 5 consecutive bids is closing, and his position is among the top 5 bidders, he will be disqualified for that auction, as this goes against the level playing field PyraBid intends to maintain for all its Users.

8.9 All Auctions begin at a specified time, with a Starting Price of £1.00 up to the maximum price set by the company on the auction page.

8.10 Each Product listed on an Auction is set to run for a particular time period. An auction is closed only when the number of bids left is 0 and the timer reaches 0. In the event that the number of bids left has not reached 0 by the time the clock has reached 0, then the timer will restart the clock until the number of bids left is 0.

8.11 All Auctions display the Timer Countdown as well as the number of remaining bids. There can be discrepancies between the Server Timer and the Timer which appears on the User’s screen. The Company shall not be liable for any such discrepancies which fall outside the control of the Company.

8.12 Once the Auction is closed, the Winning Bidder will receive a notification confirming his win by e-mail. He will also be provided with all the information related to the available Payment Options, time limits to proceed with Payment, and the delivery of his Product.

8.13 The Registered User who wins an Auction has the right to convert his winnings into credits for certain Auctions only. This is applicable to some Auctions only. Users will also have the right to request a voucher in lieu of the product’s RRP set up by the Company. However, the Company will reserve the right to choose the voucher company provider.

8.14 By participating in any given Auction, a Registered User is agreeing to purchase the Product in the case he wins that Auction. The Winner will be required to pay for his Product within 14 days after receiving confirmation of his win.

By failing to make payment within the required period, the Registered User will forfeit his right to buy the Product.

8.15 The Registered User who places the Lowest Unique Bid before the Timer Countdown reaches zero and the number of remaining bids also reaches zero is deemed to be the Auction Winner. He will be sent a confirmation email offering to purchase the Product for the Closing Price. The Auction Winner is solely determined by the Company's records. In the event of any dispute arising, the Company's decision on who placed the Lowest Unique Bid on the Auction will be final.

8.16 The Winning Registered User is not allowed to have his Winning Product delivered to any other person or address other than his own. Any product won by the User is strictly for his own private use only and cannot be resold.

9. Membership

Pyrabid.co.uk is a dedicated membership Subscription website. Membership will start after the initial 14 days cooling-off period from the date of purchase of any Credit Package.

The flat membership subscription fee of £49.99 will be charged on a monthly basis which includes generous and rewarding value added services.

All Members will enjoy distinctive benefits such as:

  • 100% Welcome Bonus on their first Deposit
  • £60 worth credits
  • Free delivery at their doorstep
  • 25 free bids every week
  • A chance to win £150 in our monthly draw exclusive to all our members (Conditions apply: members can win once only in a year)

The membership subscription is contracted for a minimum of 3 months period.

10. Membership Cancellation

A Registered User may cancel his membership any time after the registration. Any cancellation request should be made by email and addressed to the Support Team: support@pyrabid.co.uk.

Once the Support Team has received the formal request, the cancellation process will take 3 working days.

If the cancellation request is sent within the first 14 days of their cooling-off period, they will not be charged any monthly membership fee.

Currently we do not provide refunds unless it is within the first 14 days cooling off period or due to exceptional circumstances and subject to section 17 in our refunds policy.

11. Winning Limits

In order to ensure a level playing field, the Company operates restrictions which limit a Registered User from Winning 3 Auctions in any given month and not more than 6 in a year.

Winning Limits may be amended by the Company at any time, without notice to any Registered User.

12. Products

12.1 All Products listed and sold on the website are brand new and are under the manufacturer’s sole warranty. The Company includes no other warranties with regards to the Products, or any related services performed by PyraBid or any of its agents or subcontractors in connection with any order.

12.2 The Product descriptions on the website attempt to fairly and accurately describe the Items listed in the Auctions. However, before a Registered User decides to bid on an Auction, he is strongly advised to verify the Product’s specifications with the manufacturer.  

12.3 The images of Products displayed on the website are for illustration purposes only. Although the images constitute a representation of the Product as accurate as possible, they rarely represent the actual Product that the Winning Bidder will receive.

12.4 The Company or the third party supplier may in rare cases send an incorrect Product to a Registered User. In the event that such an error occurs, it is essential that the Registered User contacts the Company as soon as possible at: support@pyrabid.co.uk.

The User will be notified by the Company that the wrong Product was sent to him, and he will be given all the information related to the return of the Product. The User will have 14 days from receipt of the incorrect Product to return it to the Company. Upon receipt of the Product, the Company will send the correct Product to the User.

12.5 Please be advised that if the User fails to return the incorrect Product within 30 days, his account will be suspended and the Company may start Court Proceeding to recover the costs.

12.6 The Company shall not be liable for personal injury and property damage resulting from the incorrect handling or misuse of the Products by the User or any other person following the delivery. The Company will not be liable for any incidental or consequential damages of any kind. The Company shall not be liable for any other losses such as but not limited to, loss of income / revenue; loss of business; loss of profits or future contracts; loss of data; or waste of management whether caused by tort, negligence, or breach of Contract.

13. Payment

13.1 Credit Packages and Won Products must be paid for using one of our online Payment facilities. This Payment Process requires a Registered User to confirm his acceptance to buy a Credit Package or a Product and agreeing to the Terms and Conditions set by the Company.

13.2 In the event that a Winning Bidder proceeds to the payment of his win to the Company, but that payment is incomplete, then the Product will not be shipped until the total amount due is not received by the Company.

13.3 A Registered User has the right to buy the Product on which he placed the Lowest Unique Bid before the Auction Timer reaches zero and the number of remaining bids also reaches zero. The Company then has to sell that Product to him for the price of the final winning Bid.

14. Collaboration

14.1 The term Collaboration refers to an agreement and the subsequent co-operation between two or more Registered Users with the intent to:

  • Win an Auction in a fraudulent/aggressive bidding manner;
  • Restrict other Users’ chance to win that Auction;
  • Limit the level of fair play intended by the Company

Collaboration also includes the following:

  • Several Registered Users bidding as a team on that Auction with the intent to win. They could be members of the same household, family or friend circle.
  • A registered User creating numerous Accounts and bidding under more than one Username
  • A Registered User allowing other individuals to use his Account on the website

14.2 Should the Company feel that there is possible collaboration between Registered Users on any Auction, we will investigate the Auction and may suspend suspicious Account holders in the meantime.

14.3 In order for the Company to conclude that Collaboration took place between its Registered Users, it should base its investigation upon concrete evidence. Once Collaboration has been identified and investigated, the Registered User(s) will be notified.

14.4 The Company will investigate any suspicion of collaboration on an individual basis.

14.5 In the event the Company identifies collaboration between the Users or a single User opening multiple Accounts to participate in the same auction with the aim of winning the Auction in a fraudulent manner, the User(s) accounts will be suspended and all his/their wins will be revoked. As a consequence, the User(s) will not be allowed to make any claims related to the refund of the money they deposited on PyraBid or the bids they have placed in that Auction.

15. Suspension

The Company reserves the right to suspend or ban a Registered User if:

15.1 he has breached our Terms and Conditions;

15.2 he has developed extensive knowledge regarding the Company’s internal procedures and its operating system enabling him to act in such a way that is preventing the Company to ensure a level of fair play on its website between all its Registered Users

15.3 he was found guilty by the Company to collaborate with other Users in order to win an Auction in a fraudulent manner

15.4 The Company suspects that he is intending to harm the website in any way 

15.5 A Registered User who has been found guilty of collaboration will not be allowed to access his Account anytime in the future.

A Registered User who is suspended may:

  • Be prevented to use the Credits in his account
  • Have his winnings revoked due to the fraudulent manner in which they were acquired
  • Be prevented from opening another account on the Company's website or re-accessing his account on the Company’s website.

16. Delivery

16.1 At the time an Auction closes, the winning Registered User is required to pay for the Product at the Closing Price. When the Timer reaches zero and the number of remaining bids also reaches zero, and the User proceeds to the payment of the Winning Price, the Company is then obligated to deliver that Product to the Registered User.

Delivery will be made to the address provided by the Registered User and verified by the Company.

16.2 If a Registered User fails to confirm his identity by providing us with a valid document, the Company will have the right to void the contract between the Company and the Registered User. Furthermore, until any such document has been received and approved, the Company will not send the Product won by the User and paid for.

16.3 From the date the Registered User has completed payment of his winning Product, the Company will deliver the Product within 30 working days. We reserve the right to extend the delivery times in the event of exceptional circumstances such as sourcing the Product which are preventing us from honouring our timescales. The delivery times are estimate only and we cannot guarantee the exact delivery date.

16.4 The Company will not be liable for any delay caused by the Courier Company or third party suppliers.

16.5 If a Registered User does not comply with the Company’s requirement to provide us with accurate and verifiable information, then the delays incurred regarding the delivery of the Product will be his sole responsibility.

16.6 In the event the packaging of a Product delivered to a Registered User has been damaged during transit, he is strongly advised to refuse to take the delivery of the Product. Once the User has accepted the delivery of the Item, he should open the packaging to verify that the Product has not suffered any damage during transit.

16.7 The Registered User should also check that the Product received is not faulty after carefully removing the packaging within the Return Period of 14 days. If the Registered User notices any fault during the Return Time Period, he should contact our Support Team at: support@pyrabid.co.uk.

16.8 In the event that the Registered User identifies a fault with the Product once the Return Period is over, he should raise this issue with the Product’s manufacturer only.

16.9 In Europe excluding the United Kingdom, all the Registered User's rights under European Directive 1999/44/EC plus all domestic consumer laws of the receiving member state apply in full in relation to faulty Products. In the United Kingdom, all the Registered User's rights under the Sales Of Goods Act 1979, plus any amendments and effective domestic laws, apply in relation to faulty Products.

16.10 Bearing in mind the applicable legislation, the Company will then assess whether we will replace the faulty Product. If the Company decides to replace the Product, the Registered User should first return the Product to the Company at his own cost.

16.11 If the User fails to return a faulty or an incorrect Item within the given time period, then his account will be suspended until further notice. Furthermore, the Company will reserve the right not to replace it.

16.12 Delivery will be free for all the Users purchasing a credit package of a minimum of £50.00.

17. Returns and Cancellations

17.1 A Registered User has the right to decline the purchase of the Product won both before and after making payment within the Return Time Period of 14 days. In order to proceed with the cancellation of his winning, the User will need to contact our Support Team at: support@pyrabid.co.uk.

17.2 In the event the User has already made a payment to the Company, then he will be refunded the exact amount paid to the Company through the same payment method used by the Registered User within 14 days of the Product being returned to the Company.

17.3 Our Support Team will inform you of the procedure, including the address where the Product should be returned to.

17.4 If a Registered User cancels his offer to buy his winnings, then the Company will be under no obligation to refund him with the costs associated for its return.

17.5 If the Registered User decides to cancel before delivery of the Product, he can refuse to take delivery of the Product.

17.6 For the cancellation to be processed by the Company, the User should first return the Product that was shipped to him within 14 days of its receipt. Once the Company has received the Product sent by the User, we will refund him with the amount paid for the Item.

17.7 If after notifying the Company about his wish to cancel his order, a Registered User does not return the Product to us or returns it in a damaged condition, we will exercise our right to assess the financial losses incurred to the Company and may claim for compensation to the Registered User.

18. Refunds

When cancelling his Account, a Registered User will not be refunded the cost of Credits Purchased or remaining credits in his Account.

Refunds will be solely and strictly issued to the Registered Users who did not participate in any auction or use any awarded / purchased credits, rewards received from the Company.

All the credits purchased are non-refundable.

After a Registered User has purchased a Credit Package, he cannot hereafter withdraw either the funds deposited in his Account or any Membership privilege which was awarded to him.

In the event your refund request has been approved, an administration fee of 10% will be deducted from the total amount to be returned to you.

The company will be under no obligation to refund the user any difference in the currency exchange rate incurred during any transaction carried out by the user on the site.

19. Charge-backs

The Company reserves the right to take action if a Registered User has acted in a fraudulent manner in instituting a charge-back with his bank or Credit Card Company. The Registered User will thus be violating our Terms and Conditions, and as a consequence any contract between the Registered User and the Company will be voided with immediate effect.

20. Disclaimer

20.1 The Company makes no warranty that the service shall meet the User's requirements, that the service shall be uninterrupted or/and timely or/and secure or/and error free; nor does PyraBid make any warranty as to the results that may be obtained from the use of the service or as to the accuracy or reliability of any information obtained from the service. Cancellations and alterations shall be effected only on the receipt of application regarding the same in writing.  There are no express representations and warranties, whether express or implied, made by the Company regarding the accuracy and/or quality of any information transmitted and/or obtained through the use of the Services of PyraBid. The Company disclaims all liability and responsibility with regards to the reliability of content on the Website, together with any third party who may be responsible for such content. As far as the Company is concerned, the content laid out on the website is as accurate as possible.

20.2 The Company will not be liable for any time difference arising between a message released through a gateway/ server and such message finally reaching the End User from the concerned service provider. Further the Company is not responsible for the accuracy, quality and/or contents of any information available, received and/or transmitted through this Service. All information is accepted in good faith and the Company accepts no liability whatsoever regarding the bonafide of the user.

20.3 The Company cannot guarantee that all Registered Users will enjoy uninterrupted access to our website. The following but not limited to site attacks, viruses, internet connection failure, geographic location, power cuts or network failures are outside the control of the Company. In such circumstances, the Company will endeavour to comply with our obligations in a reasonable timescale.

20.4 The Company reserves the right to alter the remaining time for any given Auction or restart it if deemed appropriate given the above circumstances.

20.5 The information related to any Product or Service listed on the website is intended to be as accurate as possible. However, at times there may be inaccuracies or errors.

20.6 The Products purchased from the Company are available on as “is” and “as available” basis. To the fullest extent possible, the Company and its providers disclaim all implied warranties related to the provision of services and Products.

20.7 The Company will not be liable for any force majeure event, site attack, technical issue or any other factor. The Company shall not be held responsible for the losses incurred to a Registered User’s use of the website.

21. Site Attacks and Force Majeure Events

21.1 The Company will not be liable for any failure to perform, or delay in performing any of our obligations that is caused by any of the following but not limited to an act, event, site attack, server failure, or accident beyond our control. Force Majeure Events include without limitations: strikes, lock-outs or other industrial action; civil commotion, riot, invasion, terrorist attack, war or threat or preparation for war, fire, explosion, implosion, storm, flood, earthquake, subsidence, epidemic or other natural calamity; impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport; impossibility of the use of public or private telecommunications networks; and, the acts, decrees, legislation, regulations or restrictions of any government, and Acts of God.

21.2 Until any force majeure event has stopped, the Company will suspend any Contract with its Registered Users. The Company will endeavour to find an alternative solution to perform their obligation within a reasonable timescale.

21.3 In the event the Company’s website has been the target of an attack, and as a result the Auctions cannot progress in a safe and normal way, the Company reserves the right to restart the clock when the attack has been contained.

21.4 If during that time, a Registered User has been notified that he has won an Auction, and has proceeded with the payment of his winning Product, the Company will refund him the amount he has paid for that Product and explain to him the reason why his offer to buy a Product cannot be accepted by the Company.

All Bids made by Users in such circumstances will be returned by the Company.

21.5 If the Company needs to restart an Auction in the event of a Site Attack or due to any other technical problem, a Registered User is entitled to be returned all Paid Credits he spent on the Auction in question. However, this right does not apply to the return of Free Credits/ Free Bids awarded to him by the Company.

If a Registered User was notified at that time that he “won” an Auction and completed the Payment Process, he will be returned the money he paid to the Company.

22. Liability

22. 1 In the event that a defective Product causes damages to property, death or personal injury to the User himself or any other person who has been in contact with the Product, the User should refer to the Product's manufacturer only. PyraBid shall not be liable for any damages referred to above.

22.2 The Company shall not be liable at any time for any faulty computer hardware or software processing during the Bidding Process. All the allegations made by a Registered User related to but not limited to the above dysfunctions, regarding being prevented from winning an Auction will be rejected by the Company. No matter the context in which the Registered User found himself at the time of bidding on the website, he will have no right over any Product.

22.3 The Company will not be liable for any damages or injury caused by any failure of performance, error, interruption, delay in operation or transmission, computer virus, communication line failure, unauthorised access, negligence, or any other factor.

22.4 Furthermore, the User acknowledges that PyraBid is not liable for the defamatory, offensive or illegal conduct of other Registered Users or third-parties.

22.5 The Company shall not be liable for any indirect / direct loss resulting from any Registered User or third party which he may incur due to the exercise of our rights.

22.6 Only Users resident in the United Kingdom, Ireland, Isle of Man, United States, Canada, Australia and the European Union can use our website. However, there are no restrictions for users outside these territories in participating in an Auction, provided they participate in accordance within the laws of the country they are participating from.

23. Your Data

The Company processes information about its Users in accordance with our Privacy Policy. By using our site, you consent to such processing and you warrant that all data provided by you is accurate. To know more about how we process your data, please read our Privacy Policy.

24. Copyright

24.1 The Company is the owner or licensee of all intellectual property rights on this Website and material published on it. All such material is therefore protected by copyright laws and treaties around the world and all rights relating to the same are reserved. A User may not copy or reproduce any materials found on this website nor use any images, photographs or videos.

24.2 The Company owns the name and trademark of Pyrabid.co.uk. The associated graphics and logos may not be used or reproduced without the prior written consent of the Company.

25. Applicable Law and Jurisdiction

25.1 Any dispute arising in connection with these Terms and Conditions or any Item or service purchased through PyraBid will be solely governed by English law.

25.2 We make no representations that our site is appropriate or available for use outside the United Kingdom. If you access our site from any other jurisdiction you do so out of your own volition and you are solely responsible for complying with the applicable laws.

26. Waiver

If any of these terms and conditions or any provisions of a purchase contract are determined by any competent authority to be unenforceable to any extent, such term or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law.

27. General

27.1 This website endeavours to give all its Registered Users the opportunity to win one or more Auctions (not exceeding the winning limits in any given timeframe) in all fairness to them. As such, all Registered Users are expected to maintain a level of fair play while using this platform. In the event a Registered User is found in Breach of the website’s Terms and Conditions, we will reserve the right to terminate his account immediately.

27.2 In the case of a severe error with the Auction price and/or the number of remaining bids, the Company will refuse any offer by any Registered User to buy that Product. In the event the Registered User has completed the Payment process, he will be returned the money he paid to the Company. Further, if the Company rejects a Registered User's offer, this latter will be compensated and refunded the exact amount paid by the Registered User.

27.3 The Company may refuse to discuss any Account with an individual other than the Account holder himself.

27.4 This website may contain links to other websites operated by third parties. The Company shall not be liable for the content of external links and does not endorse any of the linked websites. The owners of the third parties websites linked to and from this site are solely responsible for their contents. The Company strongly encourages its Users to go through their Terms and Conditions and Privacy Policy before starting using it.

27.5 The Company has the right to change the running time of an Auction at any time without notice to any Registered User.

27.6 The Company has the right to remove any Auction at any time, should the Company believe that the Auction has been listed with a technical error or in the event of a Site Attack.

27.7  By registering an Account with us, you therefore agree to indemnify and hold harmless PyraBid, P&M Horizons, our employees and any third parties involved in our business from and against any claim and expenses, including legal costs, arising out of your use of the website, including but not limited to your breach of our Terms and Conditions.

27.8 All comments and feedback reported to the Company by any Registered Users are the exclusive property of the Company. When a Registered User submits any feedback, he hereby agrees that the Company may use it without restriction and without compensation to him.

27.9 The Company reserves the right to monitor all traffic, Users’ activity, and Users’ account details on the website so as to prevent and fight against any harmful intrusions which may cause damage to the website.

27.1.0 No individual who is not a party to the Contract will have any right to enforce it in any way pursuant to the Contracts (Rights of Third Parties) Act 1999.

27.1.1 These Terms and Conditions represent the entire agreement between the Company and its Registered Users in relation to the subject matter of any Contract and supersede any prior agreement, understanding or arrangement.

27.1.2 The Company acknowledges that, in entering into a Contract, the Company has not relied on any representation, undertaking or promise given by the other or to be implied from anything said or written in negotiations between the Company and its Registered Users prior to such Contract except as expressly stated in these Terms and Conditions.

27.1.3 Neither the Company nor its Registered Users will have any remedy in respect of any untrue statement made by the other, whether orally or in writing, prior to the date of any Contract (unless such untrue statement was made fraudulently) and the other party´s only remedy will be for breach of Contract as provided in these Terms and Conditions.

27.1.4 The Company reserves the right to take action and/or seek any remedy available under any law and jurisdiction, including injunctive relief, against anyone who, in our opinion, is in breach of these terms and conditions. Such action includes, without limitation, terminating the Registered User’s registration and terminating access to the website and its auctions.
